Ángel Cano Martínez España, S.A., from now on ACM, declares that the personal data from the CLIENT/AGENT/RESELLER, supplied through this online form, will be introduced in a file created and maintained under the responsibility of ACM, located in San Javier (Murcia - Spain), Rd. Pintar 95. This form should be completed in all those fields indicated as mandatory in order to be processed and analyzed by the ACM's Channel Team.
ACM guarantees that only the data of the legal persons that have been accepted by ACM as CLIENT/AGENT/RESELLER will be stored and registered in the personal data file. ACM will contact the potential AGENTS/RESELLERS interested, and inform of their acceptance or rejection, proceeding in any cases to destroy or keep the data under a new code of AGENT/RESELLERS.
ACM recognizes that the personal data obtained will be used for the sole purpose of monitoring and managing the operations carried out by the AGENTS/RESELLERS as is recognized by the present contract and more accurately for the calculation of the sales, commissions and for its accounting management. The personal data of the AGENT/RESELLER, and especially the e-mail address, will be used to communicate any problem detected in providing the service, or for the management of the orders as well as to keep them updated with the latest news in services, prices or commissions.
ACM guarantees that the personal data of the CLIENT/AGENT/RESELLER will be dealt with maximum confidentiality and secrecy. According to this, ACM will adopt all applicable security measures to avoid the loss, alteration, processing or access by unauthorized third parties.
In the suppose ACM is to transfer any of the personal data of the CLIENT/AGENT/RESELLER to a third party, ACM will be bound to previously obtain the clearly identifiable permission of the CLIENT/AGENT/RESELLER in order to execute this transfer, reporting the purposes and final destination of the data to be transferred, as well as of the identity, direction and type of activity of the third party.
The CLIENT/AGENT/RESELLER will be able to request, at any moment, the access to his/her personal data file stored by ACM, in order to obtain this information or to correct, cancel, modify or oppose the processing of his/her personal data, according to the procedure created by ACM to this effect. In order to exercise this right, a written notification should be addressed to ACM ESPAÑA, S.A. Ctra. Pinatar 95, San Javier - Murcia (España) or by e-mail to: info@acm-spain.
The CLIENT/AGENT/RESELLER should supply ACM, through the service activation and/or product purchase forms, with the client's personal data, including the necessary professional information, in order to provide the service or product hired, as well as the necessary information to invoice the client. In these cases, ACM agrees to inform the clients, of the source of the information, the identity of the person responsible for the processing of the data, of the information recipients, of the existence and purposes of the file and of the exercise of the rights given by law to agree, rectify, cancel or oppose the compilation of personal data.
The CLIENT/AGENT/RESELLER compromises to treat the clients personal data as confidential, and to comply the obligations established by the Law 15/99 of 13 of December, and especially, to establish the adequate procedures to limit the access and use of the data to those workers that need to use the information for the execution of their jobs. The CLIENT/AGENT/RESELLER declares to know his/her rights of confidentiality in the personal processing of data and guarantees the fulfilment of the following obligations:
- To guarantee the processing of the personal data only and exclusively for the execution of the obligations established in the present contract.
- To adopt and apply the necessary basic level security measures to assure the confidentiality, secrecy and integrity of the personal data, according to the established by the Regulation of Security 994/1999 of 11 of June. To this respect, ACM will be able to request the CLIENT/AGENT/RESELLER the presentation of the applicable document of security in the business.
- In no case, the personal data will be surrendered to third persons, not even with the purpose of its preservation.
- to destroy the data surrendered once finalized the present contract, without damage of the maintenance of a historic file during a maximum of four years to attend future judicial or administrative requests.
The violation of these obligations by the CLIENT/AGENT/RESELLER legitimizes to ACM to terminate automatically the present contract, losing the CLIENT/AGENT/RESELLER the right to the commissions yielded from the date in which the breach is detected.
